It is the responsibility of all governors to keep the children and young people in school as safe as possible. All schools must ensure that they keep their Single Central Record up to date. This includes information about Governors. All governors must have an enhanced DBS in place. It is the responsibility of the Head teacher to ensure this happens.
The Clerk to the Governing Body should keep a list of all governors and remind them to renew their DBS as required.
The School Governance (Constitution) (England) Regulations 2012 Schedule 4 point 16 states:
"A person is disqualified from holding or continuing to hold office as a governor at any time when the person refuses a request by the clerk to the governing body to make an application under section 113B of the Police Act (c) for a criminal records certificate."
Also, The School Governance (Constitution) (England) Regulations 2007 Community and Special Schools regulation 21 and Schedule 6 (6.2) state:
"A person is disqualified from being a governor or associate member if they... "refuse to an application being made to the Criminal Records Bureau for a criminal records certificate".
In addition to the DBS all governors are encouraged to complete the Level One Safeguarding training. This can be accessed through the Learning Zone or North Yorkshire Safeguarding Children Board website. See Training; click on "E Learning Course", "Introduction to the Basic Awareness Training".
Some Governors will be involved in appointing staff members; this could be a Head teacher or other staff members. The requirement remains that at least one member of a school recruitment panel must undertake appropriate safer recruitment training. However, from September 2014 this training does not have to be approved by the Secretary of State. Responsibility for choosing appropriate training rests with schools and to assist them in doing so, schools may wish to take advice from their LSCB. It is important that several governors complete this training to ensure that the school has an appropriate person to act on appointment panels at all times.
